INCOTERMS AND THE NEW VERSION 2010
Incoterms are the basis of international trade. If we take the example of two companies in two different countries, each of them having their
own language, commercial and cultural boundaries and geographically located far from each other, it is necessary for these companies to find a common language, if they wish to do business together.
Incoterms are thus designed to help importers and exporters in this approach: they define three essential points:
► the transfer of costs ;
► the transfer of risks ;
► the obligations in terms of
documentation on the buyer
and seller side in international
transactions.
Although the use of Incoterms is not mandatory, it is highly recommended for worldwide sales operations. The INCOTERMS English abbreviation for "International Commercial Terms, are recognized by all actors in international trade.
They were established by the International Chamber of Commerce in Paris (ICC) in 1936, to avoid international disputes in a purchasing or sale operation.
Since that date, the ICC has revised Incoterms periodically . Six updates have been made, the latest version being in 2000 : Incoterms 2000.
They are currently 13 Incoterms, of which the most commonly used are below mentionned :
E Ex-works (EXW)
F Free Carrier (FCA)
Free on Board (FOB)
C Cost and Freight (CFR)
Cost, Insurance and Freight (CIF)
Carriage Paid To (CPT)
Carriage and Insurance Paid to (CIP)
D Delivered Duty Uncleared D (DDU)
The fully revised text of Incoterms 2010 should be published around October 2010 taking into account international trade developments, especially the evolution of international transport and forwarding information.
They shall come into force on 1 January, 2011.
What are the expected changes with Incoterms 2010?
► Simplification of Incoterms ;
► Reduced use of FOB, reserved
for the transport of bulk goods ;
► A major revision of Incoterms
group "D", that is to say
Incoterms of sale at destination
and the introduction of two
new Incoterms ;
► A specific provision with regard
to cargo security and safety ...
